UK Immigration Changes | Latest Immigration Rule Changes October 2023

The most recent UK immigration laws. The home office has changed HC1780, the statement of amendments to the immigration laws. The following EU settlement plan modifications, electronic travel permission updates, the addition of appendix children, a larger youth mobility program, and settlement concessions for pre-1997 Gurkhas and Hong Kong military veterans will all be included in this update.

1. EU settlement scheme adjustments

For refusals of adjustments under the EU settlement plan, administrative review rights will be withdrawn. According to this, if your application is denied or you are given pre-settled status rather than settled status after October 5th, 2023, you will no longer be able to request an administrative review.

2. Electronic travel authorization updates

The UK will introduce its electronic travel permission program in October 2023. After that, non-visa nationals traveling to or through the UK will need to obtain electronic travel permission. Another significant difference is that NHS debt is no longer a reason to reject an electronic travel authorization application.

3. Introduction of appendix children

There will be a new, thorough appendix introduced that is devoted to children and covers the requirements for people applying either independently or as dependents.

4. Expanding the Youth Mobility Scheme

Under this scheme, the age range for citizens of Australia and Canada will be widened. From 18 to 30 to 18 to 35 will be included. Additionally, the length of stay will expand from two to three years.

5. Settlement concession for pre-1997 Gurkhas and Hong Kong military veterans

The 2009 exception for pre-1997 Gurkhas will formally be incorporated into the requirements for immigration to the UK. For Hong Kong military personnel who served before 1997 and their families, a new route will be established.

Changes made in the EU settlement scheme

You should be aware of recent modifications to the EU settlement mechanism if you plan to apply. If you encounter a judgment that, due to a case-working issue, appears to be incorrect, you can contest it via administrative review, which the home office will later analyze and decide whether it is proper.

However, the Home Office has announced revisions to the immigration law that will eliminate the right to an administrative review of judgments regarding applications for the EU settlement plan. This modification will take effect on October 5, 2023, and it will affect the following applications:

  • Pre-settled status
  • Settled status
  • Family permit applications

Additionally, by the Citizen’s Rights Agreement, EU Settlement Scheme applicants will still be able to properly appeal to the First Tier Tribunal through this route. The judgment will be examined by a judge from the home office.

UK Net Zero Policies

Message from Rishi Sunak addressing UK Net Zero policies. UK Prime Minister Rishi Sunak has announced a U-turn on certain UK Net Zero policies.

There has been a significant change in policies recently. Rishi Sunak claimed that new gasoline and diesel cars would be oversold from 2030 to 2035 as a postponement of the ban. The objective for this change, according to the Prime Minister, is that by 2050 there will be Net Zero carbon emissions, and the UK will align with countries like France and Germany.

The goal of this is to make it easier to meet energy efficiency goals for rental homes and replace gas boilers with heat pumps. However, there have been some reservations about this plan, particularly given that the general election is coming up and the current living cost issue.

Following the policy change, there have been some heated debates, with some supporting the pragmatic approach and others opposing it since it will affect the UK’s commitment to fighting climate change. How these developments will impact the political and environmental climate of the UK will become clear in the coming months.
