Foreigners’ Permits Will No Longer Be Revoked If They Spend More Than Six Months Abroad
Foreigners with temporary residency permits in Spain will no longer be subject to the same severe regulations, according to the Spanish government.
According to the authorities, even if a foreigner stays outside Spain for longer than six months, their temporary residency visa will no longer be canceled.
As a result of these recent modifications, everyone in possession of a temporary residence permit from Spain is now free to go abroad for more than six months in a calendar year without worrying about the validity of their permission.
The Spanish Supreme Court decided on June 20 not to withdraw the temporary residency permits of foreigners who stay outside of Spain for more than six months.
The government has emphasized that even though the nation has made this choice, the prior restrictions can still be reinstated if necessary.
According to the Olive Press, under the prior regulations, anyone who did not adhere to the six-month requirement might have their residency permits revoked by the authorities.
Temporary Resident Status
Contrarily, it has been emphasized that currently, the temporary resident status may only be canceled through a legal process when authorities determine that a particular person should no longer be eligible for the document rather than because of the length of absence from Spain.
Once a foreigner has resided in Spain for five years under a temporary residency visa, they may apply for a long-term resident permit.
The Olive Press emphasized, however, that there may be difficulties for foreigners looking to convert their temporary residency cards to permanent status after five years of residing in the nation.
The present restriction, which prohibits foreigners from leaving the country for more than ten months in a five-year period prior to applying for a permanent residency card, is still in effect.
This implies that all foreign nationals who leave Spain for a length of time longer than six months are eligible to renew their residence permits, but they are not eligible to upgrade their permits to permanent status since their absence would exceed 10 months in a five-year period.
Non-EU nationals requesting a temporary residency permit in Spain must provide their passport and a copy of it, a criminal background check, three passport-size photos, proof of travel health insurance, and the filled-out application.
