Working Abroad in Mexico | A Complete Guide For Foreigners

Foreigners can obtain a visa and work in Mexico in a variety of methods. Anyone from outside the country who wants to work in the country must obtain a visa.

People who work for businesses in Mexico, for example, require a resident visa that includes work authorization. People who have worked for a foreign company in Mexico for fewer than six months can also obtain a working visitor’s visa.

Mexico has a large number of enterprises that produce goods such as food and beverages, automobiles, silver, iron, and steel, chemicals, medications, and electronics.

Why is a work permit required?

A foreign individual must obtain a valid Mexico work visa to work legally in the country in exchange for remuneration, according to Mexican immigration law. The visa is issued following a verification and inspection process by immigration officers.

Mexico Work Visa Types Available

The following are the most important types of work visas for Mexico, which allow a foreign person to enter the country and, in some situations, work.

Non-Working Tourist Visa

The “Visitor Visa” is another name for this visa. It does not grant authority or permission to engage in remunerated activities in Mexico. As a result, it is great for people who want to stay in Mexico for a short period of time because they do not need permission to engage in activities that pay well in Mexico. The foreign national is allowed to stay in the country for up to 180 days, and the visa cannot be extended or converted into a working visa.

Working Visitor Visa

This is also known as a “visitor visa,” but it allows you to work for money in Mexico. It is a typical sort of visa issued by foreign people to work temporarily in Mexico. The foreigner is allowed to stay in the nation for 180 days with permission to work in Mexico. This visa is not extendable or convertible into a working visa. This visa is given and can be obtained only from a Mexican Consulate or embassy after receiving permission from the National Immigration Institute.

Temporary Resident Visa

The temporary resident visa, also known as the “Residente Temporal” visa, is granted to employees who want to stay in Mexico for more than 180 days but less than four years and intend to work. The visa is only available to employees who have a long-term contract with a Mexican firm. This visa is provided in order to obtain a Residente Temporal permit. The visa holder must apply for the Temporary Resident Permit within 30 days of arriving in the country. Employees with this visa are also permitted to enter and exit the country on many occasions.

The temporary resident permit is only granted to those who have made investments in Mexico who have been invited to work by a Mexican company, or who have purchased real estate or have a family in the country.

This visa can be extended for a maximum of four years. After four years, the temporary resident visa cannot be extended, however, it can be converted to a permanent residence visa on request.

Permanent Resident Visa

This is also known as the Visa de Residente Permanente, and it allows international tourists to stay in Mexico indefinitely. This visa is appropriate for those seeking permanent residency in Mexico or eventual Mexican citizenship. To obtain this visa, the applicant must have family links in Mexico as well as sufficient income to support himself. Alternatively, they must have four years of continuous status as a Temporary Resident.

Mexico Work Permit Requirements

The majority of employees will need a permanent resident visa to work in Mexico. Not all employees, however, are eligible for a permanent resident visa. Having family links in the country, an adequate monthly income, and four years of regular status as a temporary residence visa holder are all requirements.

In this instance, businesses should apply for a temporary resident permit on behalf of their employees in order for them to work in Mexico.

While some requirements may vary, several basic documents will be necessary when applying for a work visa in Mexico. They are as follows:

  • Form for requesting a visa
  • A valid passport is required.
  • A duplicate of the migratory document
  • Photo identification is required.
  • A private or public institution’s invitation
  • Valid proof of finances, job, and relationship with the Mexican government

Mexico Work Permit Application Process

  1. Before submitting an application for a Mexico work visa, firms must make a job offer to the foreign employee. The job issuance will demonstrate that the foreign citizen will be hired by the company in Mexico. According to the Federal Labor, the employer must have 10% of the company organization owned by foreign nationals, and technical positions held by foreign nationals cannot be filled by a Mexican native.
  2. The offer letter must provide general information about the position, such as activities, work duration, and remuneration.
  3. The company must then apply to the INM for a work permit for all foreign employees and provide all necessary papers. Based on INM verification and company analysis, the application will be granted. The approval status normally appears within 30–45 days. A letter is sent to the international employee and employer after approval.
  4. After receiving the work permit, the employee must submit the visa application and papers to the embassy. After the paperwork is cleared, the consulate schedules a visa interview. The individual must also present medical exam results before the interview. A staff inspection is required five days before the interview.
  5. Once the employee has passed the interview, they can pick up their work permit and visa from the consulate. The employee will then have to travel to Mexico. The term of stay for foreign employees will be verified by the Migration Official upon arrival, based on their kind of visa.
  6. Within 30 days of their arrival, the foreign employee and their family must register with the INM. Family members must apply for a dependant visa and, if they intend to work, must apply for a Mexico work permit separately.
  7. Once the employee has registered their presence in Mexico, they must begin the employment arrangement with the employer for the duration of their stay.
