Canada Government’s Change in Work Permit for International Graduates

Canada has extended the duration of temporary work authorization letters, which is a significant step in the face of continued global issues. Recently, Canada extended the validity period of temporary work permission letters granted to foreign graduates awaiting a decision on their work visa applications. Instead of the previous 120 days, work authorization letters will now be valid for 180 days after the date of application submission.

What is an Interim Work Authorization Letter?

Immigration, Refugees and Citizenship Canada (IRCC) issues interim work authorization letters, which permit foreign graduates to begin employment before the IRCC issues a final decision on their work permit application.

These documents are given to international graduates who, if they apply for a work permit before their study visa expires and meet certain requirements, can work full-time without a work permit while they wait for a decision on their application. This permits graduates to start working before receiving a decision regarding their work visa application from the IRCC.

What Conditions do International Graduates have to meet to be issued an Interim Work Letter?

Before applying for a Post-Graduation Work Permit (PGWP), international graduates who want to work must;

  • Have fulfilled the requirements for working off campus without a work permit
  • Have held a valid study permit at the time of submitting their work permit application; Have finished their program of study
  • They were enrolled full-time in a post-secondary academic, vocational, or professional training program at a Designated Learning Institution (DLI) for a minimum of eight months.
  • Graduated from their course with a degree, diploma, or certificate that did not exceed the number of work hours permitted for full-time students in Canada.

It should be noted that, due to a temporary public policy implemented by IRCC, students were permitted to work more than the standard 20 hours per week limit from November 15, 2022, until April 30, 2024.

Those who have been granted an interim work permission letter can go on working in Canada even after departing and returning, albeit many will require a valid temporary residence visa to do so. A letter of interim work authorization is not a document used for travel.

What happens if 180 days pass without a decision on an application?

The IRCC states that applicants may ask the IRCC for further documentation proving their eligibility to work if 180 days have gone by without a decision on their application. The IRCC web form can be used for this.
