Australian Visa Options for People Over the Age of 45 | Australia PR 2024

Do you wish to become a permanent resident of Australia and are over 45? We’ll go over the specifics of getting permanent residence (PR) in Australia for anyone over 45 in this update. Please remember that if you are above 45, there are other options to obtain permanent residence (PR). Nevertheless, we will only cover one pathway in this release. Designated Area Migration Agreement Visa

This type of visa allows you to obtain an employer-sponsored visa in certain regional areas up to the age of 55, or under certain conditions, a normal 482 employer-sponsored visa. If you are over 45, you can obtain permanent residency in any part of Australia with a regular 482 Visa, but there’s a catch.

You must earn more than the high-income level if you are over 45 and would like to get permanent residency on a normal 482 employer-sponsored visa. The 186 Temporary Resident Transition Stream then grants you access to permanent residency. Please remember that applicants who are over 45 typically cannot obtain permanent residency.

However, the 186 Temporary Residence Transition Stream offers an exception. Before applying, they must have been directly hired by their nominating employer in their nominated occupation for the entire two years on a 482 Visa, and they must have earned an annual salary for each of the three years that was at least equal to the fair work high-income threshold at the end of that year.

How much is the High-Income Limit?

The high-income criterion is $167,500 as of July 1, 2023. Please note that this will normally increase annually with inflation. Consequently, if you are over 45 and on a 482 visa, you can still obtain permanent residency if your salary exceeds this threshold.

What happens if you don’t earn above this amount?

Please remember that you will need to consider other Visa choices if you aren’t making the requisite amount.

Australia Subclass 491 5-Year Visa – Permanent Residency in 3 Years

Did you know that skilled immigrants have a five-year time to live, study, and work in specific regional regions of Australia with a path to permanent residency under the skilled labor Regional temporary Visa subclass 491?

If you meet all conditions, South Australia offers a state nomination option for the skilled work Regional provisional Visa subclass 491. You might be qualified to apply for permanent resident status under subclass 191 permanent residence skilled Regional Visa if you have resided and worked in South Australia for over three years on a subclass 491 visa and have met the minimum taxable income requirement.

Your South Australian state nomination provides you an additional 15 points when you apply for a subclass 491 visa under the Department of Home Affairs point system. To apply for this visa, you must first obtain Victoria’s nomination.

Who can Apply for this Visa?

To be eligible for this visa you must;

• First and foremost, be willing to move to rural Victoria (Regional nomination for subclass 491 visa)
• Next, a decision should have been made on your expression of interest
  Moreover, you must be younger than 45 years old.
• Additionally, be proficient in the English language
• Having a current skills assessment in one of the occupations listed as qualifying for this Visa.
• Also, if you live in Victoria, you must be present when nominated.
• Likewise, firmly resolved to settle in Regional Victoria.
• The Australian government’s points test requires that your indication of interest in skill choice get at least 65 points.

How Long Can You Stay with the Category 491 Visa?

Australia allows visitors to stay up to five years. However, if you intend to stay in Australia for longer than the third year, you can start applying for a PR visa after three years of completing the conditions. The visa for skilled regional workers is not extended.

How to Apply

There are four steps to applying for a visa;

• First and foremost, use Skill Select to send the Australian government’s Department of Home Affairs an expression of interest.
• Second, using the EOI number you received from Skill Select, submit an expression of interest for Victorian nomination via the Leave in Melbourne website.
• Next, if you accept the invitation, submit a nomination application via the Leave in Melbourne website.
• If your nomination application is accepted, you should also submit a visa application to the Australian government’s Department of Home Affairs for the visa you desire.

Required Documents

• First, a passport
• Also, a Police clearance certificate
• Next, the Marriage certificate (if you’re married)
• Lastly, the language proficiency report

All of the aforementioned documents are necessary to support the information in your EOI. The following documentation is further required for applicants between the ages of 18 and 23.

• A birth certificate
• A passport
• Proof of financial dependence
• In some cases, adoption papers (required for applicants beyond the age of 23 who still rely on their parents due to a physical or mental handicap)
