November 2023 Visa Bulletin Analysis

The November 2023 Visa Bulletin was made public earlier this week by the US Department of State. The most recent Visa bulletin has hardly changed at all. Unless otherwise stated, all deadlines given refer to those in the final action chart.

Visa Bulletin Summary

Employment-Based, First Preference (EB1) Category

The EB1 category has not changed; the deadline for China is still February 15, 2022, and the deadline for India is still January 1, 2017. For all other nations of chargeability, the EB1 category continues to be in effect.

Employment-Based, Second Preference (EB2) Category

With China’s cutoff date remaining on October 1, 2019, and India’s cutoff date remaining on January 1, 2012, EB2 China and EB2 India show no progress. All other nations’ EB2 cutoff date is moved up to July 15, 2022.

Employment-Based, Third Preference (EB3) Category

The EB3 category has not changed. India’s cutoff date is still May 1, 2012, while China’s cutoff date is still January 1, 2020. All other nations of chargeability will continue to fall under the EB3 category as of December 1, 2021.

EB3 Other Workers Category

The EB3 other workers category remains unchanged. China’s deadline is still January 1, 2016, India’s deadline is still May 1, 2012, and the Philippines’ deadline is still May 1, 2020. The EB3 other workers’ cutoff date for all other nations of chargeability is set to August 1, 2020.

Employment-Based, Fourth Preference (EB4) Category

The deadline for the EB4 category remains January 1, 2019, and it applies to all nations. It should be noted that the EB4 program for specific religious workers will end on November 17, 2023, as it is now planned. After that date, the EB4 category for some religious workers won’t be available if Congress doesn’t extend the program.

Employment-Based, Fifth Preference (EB5) Category

The EB5 category remains unaltered. The deadline for China’s EB5 immigrant visa numbers that are not allocated for rural areas with high unemployment or infrastructure projects is still set for October 1, 2015. The deadline for India remains December 15, 2018. For all other EB5 categories and countries of chargeability, EB5 is still in effect.
