Australia 482 Visa Update 2023-2024 | 482 Visa Australia

The path to permanent residency for all holders of TSS subclass 482 visas has been officially announced by the Department of Home Affairs. Thus, the subclass 186 Visa through the employer-nominated system. Expanding upon the announcement from earlier this year, we’ll go over each of the main features of this upgrade in this post.

The Department of Home Affairs has set November 25, 2023, as the deadline for modifications to the employer-sponsored permanent residency program. After the revisions take effect, short-term holders of temporary skill shortage 482 visas will be eligible for permanent residency under the employer nomination scheme’s 186 Temporary Residence Transition stream.

This suggests that regardless of whether they are sponsored in a post included on the Regional Occupation List (ROL), long-term MLTSSL, or short-term STSOL lists, all holders of TSS subclass 482 visas will have a pathway to permanent residency.

What is Changing?

The current system, which limits the number of applications that holders of short-term stream TSS visas may file within Australia, causes inconveniences for both employers and employees. With the impending changes, these limitations should be lifted, enabling TSS visa holders with the short-term stream to file all of their applications in Australia.

This is a significant step forward, reducing disruptions and providing these workers with a more stable path to permanent residency.

TRT Stream Nominations

The current method has a variety of restrictions on TRT stream nominations. Among these is the requirement that the recommended career path line up with lists of specialized careers. Holders of subclass 482 visas are required to have worked in the assigned job for their sponsoring employer for at least three years before applying for permanent residency.

The new law would do away with comparing the selected occupation to a list of skilled occupations and shorten the three-year application timeframe for permanent residency through the TRT stream.

Summary of the Changes

The modifications that will be applied to subclass 482 Visa applications are outlined in full below.

  • Foremost, Australia is currently accepting applications for TSS visas under the short-term stream.
  • Also, the number of short-term stream TSS applications that holders of valid visas may submit in Australia will no longer be limited.
  • Besides that, short-term stream TSS visa holders must depart Australia to submit their application for category 186 if their visas expire on or before November 25, 2023.

TRT Nomination Applications

  • Employers may now sponsor employees for permanent residency under all TSS Visa streams, including the labor agreement and short-term streams.
  • Also, applicants for visas must have had their subclass 482 or subclass 457 visa for two of the preceding three years before nomination.
  • In addition, candidates seeking a visa must have worked for their sponsoring employer for two of the preceding three years before nomination.
  • Besides that, the chosen occupation must still be identified using the standard classification of occupations used by Australia and New Zealand. It will no longer be assessed for subclass 186 against a list of skilled occupations.

TRT Visa Applications

  • First and foremost, altering the age exemptions for prospective regional medical practitioners and high earners (45 years of age and above) to create a more efficient 2-year pathway
  • Also, phase away the COVID-19 age exemptions, which will be implemented in two years and thereafter be invalid.

An important step toward providing skilled workers with a more rapid and straightforward path to permanent residency is the Australian government’s impending changes to the TSS and TRT Visa streams. The goal of these changes, which are scheduled to go into effect on November 25, 2023, is to give businesses and people with TSS Visas stability.
