The Australian government is attempting to grant permanent residency to temporary skilled workers by modifying the present Visa system through several proposed changes. Under the current arrangement, most holders of subclass 482 temporary skill shortage visas, particularly those with highly sought-after abilities, are unable to meet the standards for permanent residency.

Visa holders may convert to permanent resident visas through the temporary resident transitional stream under the subclass 186 employer nomination scheme or subclass 187 RSMS visas.

These adjustments are part of a wider reform program the government is implementing to ensure equitable access to permanent residency for all skilled workers who are sponsored. The administration also wants to reinstate a more straightforward skilled migration strategy that can again respond and adapt to Australia’s changing skill needs as they emerge.

Proposed Changes

Here are some of the most significant changes that have been recommended:

  • First and foremost, eliminating the maximum number of short-term stream TSS applications that an Australian worker may file
  • Also, enables businesses to recommend employees for a temporary ENS Visa under a labor agreement or other TSS Visa stream.
  • Furthermore, listings for occupations may be withdrawn for applications under the transitional stream if they are included in the Australian and New Zealand Standard Classification of Occupations (ANSCO).
  • Besides that, before a transitional ENS nomination, TSS holders’ needed work experience will be reduced from three to two years.
  • Above all, bringing the age exemption requirements into line allows candidates who are 45 years of age or older and who are high earners or regional medical practitioners to take a 2-year route.

Applicants are advised that all other requirements for a transitional ENS application are still relevant. Among these prerequisites are

  • First and foremost, being younger than forty-five
  • Also, having a primary applicant who speaks English at a proficient level
  • In addition, bringing in at least $70,000 a year
  • Lastly, fulfilling specific requirements for character and health

The ENS Visa TRT stream will undergo major modifications on November 25, 2023, to increase accessibility to the PR pathway for all TSS Visa holders.

What does this mean for TSS Visa Holders?

These modifications will apply to any new employer nomination transitional route Visa applications submitted on or after November 25, 2023. It is noteworthy to mention that the overall planning levels for the migration program will not alter, despite temporary skilled workers being granted greater access to permanent residence.

For sponsored 482 Visa holders who work in STSOL occupations, this is great news because it means they will now have a simple path to permanent residency, assuming they meet all requirements for that specific Visa.
