US H-1B Visa Lottery Completed! Check Your Eligibility to File the Petition
Enough unique beneficiaries’ electronic registrations were submitted to U.S. Citizenship and Immigration Services during the initial registration period for the H-1B numerical allocations (H-1B cap) for fiscal year (FY) 2025, including the advanced degree exemption (master’s cap).
USCIS has informed all potential petitioners with selected beneficiaries that they are qualified to file an H-1B cap-subject petition for such beneficiaries after randomly selecting a sufficient number of correctly filed registrations for unique beneficiaries estimated to be required to reach the H-1B cap.
One of the following statuses for each registration—that is, for each beneficiary registered—will now be displayed in registrants’ online accounts:
Submitted
The registration is up for selection; it has been submitted. This registration is still eligible to be selected in any further selections for the fiscal year it was submitted for, provided the first selection procedure is finished, unless it is later declared invalid.
Selected
Chosen to submit a petition under the H-1B quota.
Not Selected
Not qualified to submit a petition under the H-1B quota because of this registration.
Denied – duplicate registration
The same registrant filed more than one registration for the same beneficiary. All registrations made by or on behalf of the same registrant for this beneficiary during the fiscal year are void if rejected as a duplicate registration.
Invalidated – failed payment
The payment method was refused, not reconciled, or deemed invalid despite the registration being submitted.
Deleted
The registration that was submitted has been removed and is no longer available for selection.
Processing submission
Your submission is being processed by USCIS. The case details page may not display all of your case information for up to 72 hours. You will be unable to access your draft while it is processing.
FY 2025 H-1B Cap Petitions May Be Filed Starting April 1
Petitioners may begin filing H-1B cap-subject petitions for FY 2025 with USCIS on April 1, 2024, provided that the petition is for a selected beneficiary and is based on a valid registration. This includes petitions qualifying for the advanced degree exemption.
H-1B cap-subject petitions may only be filed for FY 2025 by petitioners who have registrations for specific beneficiaries.
A properly filed H-1B cap-subject petition must be submitted within the relevant selection notice’s filing period, either in person at the designated filing location or electronically via the MYUSCIS website. The H-1B cap-subject petition must be filed within a minimum of ninety days. The petitioners’ FY 2025 H-1B cap-subject petition must be accompanied by a copy of the relevant selection notice.
To prove the beneficiary’s identity, petitioners must additionally provide proof of the beneficiary’s current passport or other travel documents from the time of registration.
Registration and selection solely relate to eligibility to file the H-1B cap-subject petition; petitioners filing for selected beneficiaries based on their valid registration must still provide evidence or otherwise show eligibility for petition approval.
New Fees and Form Edition
A final regulation that modifies the fees needed for the majority of immigration applications and petitions was released by USCIS on January 31, 2024. April 1, 2024, is when the new fees go into effect. USCIS will not accept petitions that are not postmarked by April 1, 2024, unless they include the increased costs.
Furthermore, a new edition of Form I-129, Petition for a Nonimmigrant Worker, will be available on April 1, 24. The new Form I-129 must include the updated fee computation, therefore there won’t be a grace period for filing it.
