Canada’s New Open Work Permit for Spouses & Family Class 2023 | Canada Immigration
Did you know that as part of its drive to make it easier for permanent residents to bring their families to the nation, Canada has announced several new measures, including an open work permit for applicants in the spouse and family class?
While a family class sponsorship application is underway, some sponsored partners and their dependant children will move to Canada as temporary residents to live with their sponsor. Immigration, Refugees, and Citizenship Canada (IRCC) announced a temporary public policy allowing these individuals to work in Canada while their applications undergo review at the end of May.
Through this government policy, dependent children above the age of 18 who are requesting residence and employment in Canada under family class sponsorship will find it simpler to obtain an open work visa. Previously only accessible for the inland spousal sponsorship program, these open work permits are now open to anyone applying from outside of Canada.
The IRCC claims that granting open work permits will help families preserve their financial security, help them integrate into their communities, and solve the labor shortages and economic problems facing the country.
Eligibility Requirements
The IRCC may grant an open work permit to foreign nationals who meet either of the aforementioned criteria.
The non-resident alien is;
- First, a principal applicant who has filed a family class application for permanent residence as a spouse, common-law partner, or conjugal partner and received given IRCC’s approval for processing
- Next, has also applied for a work permit with a planned maximum two-year visa.
- Moreover, is the subject of a petition for sponsorship submitted by their spouse, common-law partner, or romantic partner who is a citizen or permanent resident of Canada.
- In addition, they must be eligible for and have applied for restoration of status or have current temporary residence status in Canada at the time of application. They must also have the same Canadian home address as their sponsor.
Any of the following could also be a non-resident alien:
- First and foremost, a dependent child mentioned as an accompanying family member on the application for permanent residency.
- Second, has applied for a work visa that requests a maximum of two years.
- Third, shares the same Canadian home address as the principal applicant and their sponsor.
- Above all, is eligible for a restoration of status and has applied for one, or possesses a valid temporary resident status in Canada.
Family Reunification Measures
Sean Fraser, the minister of IRCC, announced on May 26 improvements to encourage family-class immigration and family reunification in Canada. These actions comprise;
- First and foremost, quicker processing times for spouse candidates seeking temporary residence visas (TRVs), in addition to the new open work permit
- Second, cutting-edge processing tools specifically designed for spouse TRV candidates
- Third, give people whose open work permits expire between August 1 and December 31 2023 an extension.
