Australia DAMA Program for Permanent Residence 2023 | Details & Requirements
Did you know that a Designated Area Migration Arrangement (DAMA) exists between the Australian government and a local state or territory government? Under the DAMA, employers in some places are permitted to sponsor skilled and semi-skilled foreign workers for jobs they are unable to fill locally.
It is specifically made to address the current, worsening labor shortages and local employment terms and conditions. The following regions now have 12 DAMA Agreements in force:
- Adelaide City
- East Kimberley
- Far North Queensland
- Goulburn Valley
- Great South Coast
- Northern Territory
- Orana
- Pilbara
- South Australia Regional
- The Goldfields
- Townsville
DAMA is reliant on the labor agreement stream for Temporary Skill Shortage Visas (subclass 482). Once funders and the Australian government have agreed on a labor agreement, workers are granted a Subclass 482 visa.
What are the Key Elements
- The process for DAMA visa holders for acquiring permanent residence comes first.
- Second, numerous professions lack both trained and semi-skilled personnel.
- Third, pay disparities for various professions and English competence
- Next, a range of risk and integrity controls to ensure that both employee and employer rights are protected
- In addition, age adjustment
- Likewise a five-year deal, etc.
Provision for adjustments
Certain occupations may be modified for each DAMA region. These adjustments could be made in terms of remuneration, required employment experience, language skills, etc.
Proof of Experience or Qualifications
Suppose the job enlists on the Australian government’s short-term skilled occupation list, medium-term strategic skills list, or regional occupation list. In that case, the visa applicant must demonstrate an equal level of education and experience to that of the sponsor.
The usual Temporary Skill Shortage visa (subclass 482) and Employer Nomination Scheme (subclass 186) visa programs require one to follow, even if many people have access to certain adjustments. However, to work in any DAMA occupation that is not on the Australian government’s list of short-term skilled trades, long-term strategic skills, or regional occupations, a skill level 1 to 3 visa candidate must:
- First, complete a skills verification from the designated DAMA area.
- Next, request a skill assessment from the relevant skills evaluating body.
- Likewise, follow ANZSCO’s guidelines for defining skill level.
- Moreover, meet the requirements for post-qualification experience in each DAMA area.
In some of the seven DAMA zones mentioned, the DAMA program does allow for the nomination of specialized and general skill level 4 occupations.
Requirements
Some policy guidelines set forth by the Department of Home Affairs and the related DAMA agreements. These requirements include, among others:
- All three streams of subclass 482 are subject to the requirements for nomination and sponsorship in subclass 482.
- Also, make certain that every nominated occupation enlists as one that the appropriate labor agreement permits the party to nominate. Any requirements that the party to the labor agreement must adhere to, requires a demonstration to the satisfaction of the Department of Home Affairs.
- Additionally, for the nominated occupation, accept fewer nominations by the relevant labor agreement for the year in question.
Pathway to Permanent Residency
There may be a path to Permanent Residency under the subclass 186 scheme after acceptance of the subclass 482 visa and a specific time of employment under the subclass 482 visa (pending fulfillment of the requirements and availability).
