UK Immigration Ban – A Travel Nightmare! How long can one be Banned?

The length of re-entry bans in the UK varies depending on when and how a person departs the country. Additionally, individuals who are subject to a one-, five-, or ten-year re-entry ban risk having their entry to the UK denied.

Existing Duration of Re-entry Bans

  • The first restriction is the one-year ban for visitors who leave the UK voluntarily and on their dime within 30 days of their leave expiring.
  • On the other hand, those leaving the UK willingly at the expense of the Home Office are subject to two- or five-year bands. How soon they leave after getting the notification of obligation for removal will have a significant impact on this.
  • The 10-year restriction for anyone facing forced deportation or removal comes last. This also applies to applicants who provide false information.

Voluntary Departure at One’s Own Expense

If any of the following apply to a person, they will be required to serve a one-year re-entry ban:

  • First, they are unauthorized participants.
  • Additionally, those who stay on legal leave for more than 30 days
  • Individuals who violate a leave condition are next.
  • People who leave the UK voluntarily incur costs for it. Unless these people are requesting entrance clearance as members of their family or were minors at the time of their most recent violation.

Voluntary Departure at the Expense of Secretary of State

If someone violates immigration regulations and leaves the UK voluntarily at the Secretary of State’s cost, they may face two- or five-year re-entry bans. Remember that it also includes people who depart the UK via the Assisted Voluntary Return (AVR) program.

When someone leaves the UK voluntarily using a flight ticket purchased by the Secretary of State, it is referred to as a voluntary departure at the Secretary of State’s cost.

Two-year Re-entry Bans

If the departure date was less than six months after the date they received notice of their removal decision or it hasn’t been over six months since their appeal contrary to the removal decision ceased to exist, people who leave the UK voluntarily at the Secretary of State’s expense are subject to a two-year mandatory re-entry ban.

Five-year Re-entry Bans

If someone leaves the UK voluntarily at the Secretary of State’s cost more than six months after getting notice regarding their removal decision or more than six months after their subsequent appeal rights have expired, they are subject to a statutory five-year re-entry ban.

It’s noteworthy to note that the six-month period during which a person must leave the country to only face a two-year re-entry ban rather than a five-year one, could reinstate.

10-year Re-entry Bans

Facing a deportation order interestingly prohibits one from entering the UK with the order still in force. To find out the requirements for overturning a deportation order, consult the immigration regulations. After deportation, a foreign national who received a deportation order may have it revoked by applying to the Home Office from outside the UK.

Individuals removed from the UK against their will and at the taxpayers’ expense are subject to a 10-year re-entry ban. However, forced removal occurs when a person is forced to return to the UK by the department.

You should be aware that before they leave the UK, the authorities have the right to hold such individuals. In addition, if someone lies on their application, they are prohibited from entering for ten years.
