HOW TO GET ILR FROM UK SPOUSE VISA | 5-YEAR ROUTE

This article discusses how you can transition from a UK spouse visa to indefinite leave to remain. Read keenly for all the helpful information provided in this article.

A non-British individual can utilize a UK spouse visa to move in with their partner if they have British citizenship, pre-settled status, ILR, ECAA, settled status, refugee status, or humanitarian protection. You may go for an indefinite leave to remain once you complete 5 years on a UK spouse visa. For those who are unaware, ILR permits an individual to reside and work permanently in the UK without limitations.

How can a Spouse Visa Holder Apply for an Indefinite Leave to Remain?

For starters, you must have lived in the UK for 5 years on a UK spouse or partner visa before applying for an ILR. However, individuals who received their spouse visas before 9 July 2012 can go for ILR after completing 2 years in the UK.

ILR Requirements for Spouse or Partner Visa Holders

Eligibility Requirements

Interestingly, the eligibility requirements are different for a 5-year and 10-year route. You are allowed to utilize the time you spent in the UK through other visas if you opted for a 10-year route in the beginning.

However, people who are traveling for five years are prohibited from having other visas, such as those for a fiancé, fiancée, or prospective civil partner.

Financial Requirements

Individuals applying for an ILR after ten consecutive years in the UK are not required to meet any financial conditions. As far as people on a 5-year route are concerned, they must have an annual income of at least £18,600. This, however, also applies to their partner.

The following additional funds are necessary for those who have dependent children but have no British citizenship or ILR status to satisfy the eligibility requirements:

  • An additional £3,800 a year for the first child
  • Also, an additional £2,400 a year for every child that followed your first child
