Canadian Spousal Sponsorship – the IRCC’s Verification Process

The Immigration, Refugees, and Citizenship Canada (IRCC) is responsible for determining whether or not a couple is genuine in order to grant Canadian spousal sponsorship under the Family Class Sponsorship.

According to Immigration, Refugees, and Citizenship Canada (IRCC), family reunification is considered to be one of the most significant assets of the Canadian immigration system.

Canadian spousal sponsorship – the IRCC’s verification process

These assessments are carried out by the Immigration and Refugee Board of Canada (IRBC) because it is not unimaginable that a person who is not a citizen of Canada could try to build a dishonest relationship with a Canadian citizen or permanent resident in order to be given permanent residency in Canada. Despite the fact that the sponsor is aware that the couple is involved in a genuine and committed marriage or partnership, the petition cannot be approved.

In addition, if they have been granted permanent residency status, they are expected to make a pledge to provide financial support for their spouse for a length of time equal to three years. This obligation begins when permanent resident status is granted. No matter how the romantic connection turns out, sponsors could find themselves in a difficult emotional and financial situation at some point in the future.

  • Attempts by Canadians or permanent residents to manufacture a relationship and enter into a business-like arrangement with a foreign individual are also conceivable.
  • If an officer is not convinced that there is a genuine relationship, the foreign national will be denied sponsorship.
  • The government requires documentation from all couples, including same-sex couples, proving the authenticity of their relationship. The papers required will be determined by whether the couple is officially married or living together as common-law in Canada.
  • A married couple must complete several sorts of formal documents, including:
  • A copy of the IMM 5532 relationship information and sponsorship from the application package has been returned.
  • Questionnaire for evaluation.
  • A marriage certificate.
  • Marriage registration documentation from a government agency (local, provincial, national, or international).
  • If the applicant or spouse has previously been married, proof of divorce is required.

Common-law partners are required to apply for those couples who are of the same gender but whose marriage has not been recognized by the country where the foreign national normally resides. You may submit an application as a conjugal partner in the event that a couple has been prevented from living together due to a lack of available long-stay visas.

Common-law partner

In Canada, a non-married couple is deemed to be in a common-law partnership if they have lived together in a conjugal union for at least one year and have not married each other. This is the definition of a common-law connection that can be found in the law. They are required to submit the same paperwork as is required of married couples. This does not contain any photographs or invitations that were taken at the wedding.

In addition to this, they are obligated to submit official documentation of the shared costs and financial support that the sponsor has supplied to the major applicant. In addition, it includes supplementary evidence, such as a certification of the relationship from friends or family of the parties involved. You could include letters written by friends and family members as evidence, in addition to data from social media platforms that establish a public link.

In addition to this, a sponsor and lead applicant are required to produce documents from at least two of the sets indicated below in the following paragraphs. This is true for married couples as well as couples living together under a common-law arrangement.

  • Proof of joint ownership of residential property or real estate.
  • The sponsor and the primary applicant are listed as residents of the rental residence in the rental agreement.
  • Evidence of joint credit card accounts, joint bank accounts, or shared utility accounts (electricity, gas, phone, and internet).
  • Auto insurance demonstrates that the primary applicant and sponsor both identified themselves as residents of the insured’s address to the insurance provider.
  • Copies of official government documents (such as driver’s licenses) displaying the addresses of the chief applicant and sponsor.
  • Whether the accounts are joint or separate, they must provide further documentation with the same address to the chief applicant and sponsor. Cell phone bills, pay stubs, tax forms, bank or credit card statements, and insurance policies are examples.

If a couple is unable to submit at least two of these documents, then they are expected to provide a detailed explanation in writing as to why they are unable to do so.

Marriage Partners

It is necessary for a couple to present the following documents in order to demonstrate that they have been living together as conjugal partners in Canada:

  • Some types of proof include letters, public text messages, emails, social media posts, and other evidence attesting to the fact that they communicated with one another. The maximum number of pages it could have is ten, and no more than that.
  • Flight tickets, boarding cards, and photocopies of passports carrying stamps from the nation visited can all serve as evidence that a Canadian citizen or permanent resident has been to the country of their marriage. This evidence must be supplied in order to establish that the individual has visited their spouse. If there were no visits, the person who sponsored you will need to offer an explanation for Question 4 of Part C of the IMM 5532 form. This explanation will be required in the case that there were no visits.
