Canada relaxes temporary foreign worker program rules to deal with labour shortages

The Canadian government has announced plans to make it easier for Canadian businesses to hire temporary foreign workers.

Even though the unemployment rate is low, there is a lack of workers across the country, which is why these steps are being taken today.

The government communiqué says that the changes to the Temporary Foreign Worker Program (TFWP) are meant to help Canada build its workforce.

Five big changes are coming to TFWP.

Starting right away:

Labor Market Impact Assessments (LMIAs) will be good for 18 months instead of only six months before the pandemic. LMIAs are papers that show the Canadian government that hiring a foreign worker in Canada won’t hurt the country’s labor market. With this paper, the worker can move forward with his application for a work pass.

Also, the highest length of employment for people in the High-Wage and Global Talent Streams will go from two years to three. This extension will make it easier for workers to apply for more ways to get permanent residency, which will allow them to stay in Canada and work for a long time

The provision for Seasonal Limits, which has been in place since 2015, will be made permanent. Employers in seasonal businesses will no longer be limited in how many low-paying jobs they can fill through the TFWP. The longest these jobs can last will go from 180 days per year to 270 days per year.

From April 30 on:

Employers in labor scarcity areas can hire 30% of their workers for low-paying employment for a year through the TFWP. Food, wood, furniture, accommodation, food service, building, hospitals, and residential and nursing care facilities are the seven qualified industries.

All other firms can hire 20% of their workers through the TFW Program for low-paying employment until further notice. The TFW Program previously limited many enterprises to 10% of their workforce.

Finally, Canada will stop rejecting LMIA applications for low-paying hotel, food service, and retail jobs in areas with at least 6% unemployment.

Last year, the Temporary Foreign Worker Program accepted nearly 5,000 jobs on the Global Talent Stream and 23,000 jobs on the High-Wage Stream. Together, these projects account for about 21% of all LMIA jobs that have been approved for 2021.

About 50,000 to 60,000 foreign farm workers come to Canada each year through the TFWP. This is more than 60% of all foreign workers who come to Canada.
