Alberta PNP Job Offer and Employment Requirements | Canada Immigration Guide

An employment offer from an Alberta company is essential for most of the AAIP provincial nomination streams. Recently, the Alberta government imposed new conditions for Alberta firms who wish to support the nomination of their international employees.

The Alberta Advantage Immigration Program is now undergoing adjustments to most of the labor streams. While the Alberta Opportunity Stream and Tourism & Hospitality Stream are still closed at the time of writing, the program issued updated criteria in March 2024 to clarify what type of work circumstance will be necessary when these programs reopen.

Previously, it was quite simple for Alberta employers to become qualified to support their employees, and most Alberta-based businesses were eligible. The most recent amendments have included limits that aim to limit the capacity of new, smaller enterprises to designate several employees. The AAIP programs have been inundated with applicants in recent months, necessitating changes to ensure reasonable processing times, equitable distribution of nominations to established Alberta businesses, and the elimination of situations in which shell businesses were ‘operated’ almost solely for the purpose of nominating employees.

Alberta Employer Requirements For AAIP

To effectively submit your application for Alberta provincial nomination, the Alberta employer you work for must:

  • Be a legitimate business that offers a good or service in Alberta, from an Alberta location.
  • Offer you a career that aligns with their company activities.
  • Be incorporated or registered in either Alberta or Canada.
  • Been operating in Alberta for at least two fiscal years.
  • Have a minimum gross annual operating revenue of $400,000 in the most recent fiscal year.
  • Have at least three full-time employees (or full-time equivalents; contractors do not count).

If the company does not have a gross revenue of at least $400,000 or cannot show three full-time employees, its employees can still submit for nomination, but only on the following terms:

  • Two years of operation in Alberta equals a maximum of one employee nomination.
  • Three years of business in Alberta equals a maximum of two employee nominations.
  • For every additional year of business in Alberta, the company can support one more worker for nomination.

Documents Required from Alberta Employers for AAIP Applications

In addition to the traditional job offer and employment reference letter that has always been required for Alberta PNP, the additional requirements involve the Alberta PNP officer contacting the employer to give the following documentation to the worker who is applying for Alberta nomination:

  • Evidence of attempting to fill the post for which the nomination is sought (only required if the applicant is not currently working in the position)
  • Fill out corporate income tax returns for the past two fiscal years, including schedules 100, 125, and 141 (T4). Summary of Remuneration Paid for the Past Two Fiscal Years
  • This document shows all the payroll information for the company and is filed to the Canada Revenue Agency annually when T4 slips are distributed to workers.
  • Please include a copy of the company licence, as well as any relevant lease, rental, ownership, or mortgage documentation for the candidate’s work location.

It is necessary to provide proof of recruitment for any positions in which the foreign worker is not currently occupying the role. This evidence must be comparable to the information that is required for an application for an LMIA. When taken in a broad sense, this should be construed to mean that the employer is required to promote the position on job banks in addition to two additional recruitment sites that target underrepresented groups for a period of at least one month at the pay that is currently being offered in that particular region of Alberta. In situations like these, the nomination from Alberta will only be granted if the company can show evidence that no qualified Canadians applied for the post.

Greater cause for concern is the program’s premise that the employer in Alberta will provide information on taxes that is kept confidential.

Job Offer Requirements for AAIP Nomination

The job offer standards for Alberta PNP nomination remain unchanged, but they are worth reconsidering in light of the other changes. A job offer suitable for AAIP nomination must include:

  • Non-seasonal work with an employer-employee relationship (only health care providers may be contractors)
  • Full-time job (at least 30 hours each week)
  • Employment for 12 months or more.
  • Wages that either equal your LMIA approval, or meet or surpass the lowest beginning wage for that occupation in Alberta.

Alberta job offers cannot include:

  • Part-time, casual, or seasonal jobs
  • Independent contractors, owner/operators, or temp agencies work.
  • Work for a home-based business (with several restrictions under the Alberta EE stream).
  • Work outside of Alberta.

Do I need a job offer for the Alberta PNP?

Candidates must have an offer of employment from an Alberta-based employer to be eligible for the most prevalent Provincial Nominee Program (PNP) paths to Permanent Residence. Remember that not all Alberta workers qualify for Provincial Nomination. This is especially true given the strict laws that limit which firms can nominate personnel.
