Employment Overview

The Assistant Legal Officer will be recruited locally and will support the Head of Legal and Company Secretariat, as well as the Legal Counsel, in delivering legal and litigation assistance to Absa Bank Ghana LTD (ABG) by:

  • Assisting with all litigation and court-related issues, which include taking legal action against delinquent customers and other parties, defending ABG in lawsuits, and settling disputes through alternative methods like mediation and arbitration to lower litigation expenses.
  • Representing ABG and assisting the business in managing garnishees, probate, and letters of administration matters, as well as addressing court orders and various requests from statutory and regulatory bodies like EOCO, Ghana Police Service, FIC, GRA, SSNIT, Labour Commission, etc. Collaborating with external law firms and other critical internal and external stakeholders.
  • Supply periodic litigation updates, provision updates, and any other pertinent reports to the Legal Counsels and the Head of Legal and Company Secretariat.
  • Assisting in the preparation, examination, and negotiation of all contracts, agreements, and legal documents as directed.
  • Assisting the bank in maintaining regulatory compliance through the execution of impact assessments.
  • Collaborating with designated business units routinely to offer essential legal assistance and guidance so they can achieve their goals and growth initiatives.
  • Engaging in meetings and completing training as required.
  • Handling any additional responsibilities as assigned by the Head of Legal and the Company Secretariat.

Main Responsibilities

Legal, Compliance, and Commercial Collaboration Assistance – Time Distribution: 70% 

  • Take main responsibility for managing garnishee, probate, and letters of administration matters.
  • Share responsibility with the Legal Counsel for all communications between Legal and pertinent business units regarding the management and resolution of all litigation and debt recovery cases concerning the Bank that are managed by outside counsel.
  • Share accountability with the Legal Counsel for ensuring that litigation and contentious matters dealt with internally are managed competently, efficiently, and promptly in court and before other judicial and quasi-judicial bodies like CHRAJ and the Labour Commission as needed.
  • Conduct research and deliver business guidance, education, and training to specific business sectors as necessary, while assisting in the prevention of contractual and compliance violations and legal action.
  • Hold primary accountability for the engagement between Legal and designated business teams and functions regarding all legal issues affecting the operations of ABC.
  • Assistance with the preparation, evaluation, and negotiation of contracts and other legal documents related to the Bank.
  • Hold main accountability for analyzing, evaluating, and reporting on changes and developments in legislation and case law that impact the banking sector and ABG’s operations as necessary.

Administrative Assistance – Time Allocation: 30% 

  • Guarantee the timely delivery of precise and comprehensive litigation reports, provisions reports, and other pertinent documents to the Legal Counsel, Head of Legal, Company Secretariat, and related departments.
  • It is necessary to reply to and create communications for both internal and external stakeholders.
  • Organize the delivery of timely and pertinent business data and advice regarding Ghana.
  • Guarantee that pertinent reports are sent to the Head of Legal and Company Secretariat as well as the appropriate departments promptly.
  • Perform any additional duties as directed by the Head of Legal and Company Secretariat.

Education/Skills and Required Experience

  • LLB or a comparable degree from a recognized university/institution.
  • Must be a member in good standing of the Ghana Bar Association with 2 to 3 years of experience after being called to the bar.
  • One year of recent experience as in-house counsel, ideally within a bank or financial services company, is beneficial.
  • Experience in handling litigation and courtroom procedures.
  • Familiarity with conducting legal research and offering legal opinions and guidance.
  • Experience in drafting and reviewing contracts and other legal documents.

Understanding & Abilities:

  • Experience in overseeing legal disputes.
  • Experience in courtroom procedures.
  • Experience with or knowledge of senior relationship, operational, or advisory positions in legal risk management.
  • Comprehension of the legal structure, commerce, and markets in which the Bank functions.
  • Understanding of Banking Law, practices, and procedures.
  • Awareness of the banking sector in Ghana and its nationwide products, along with associated risks.
  • Expertise in delivering training sessions and conducting presentations.
  • Experience in conducting legal research and offering legal opinions and counsel.
  • Familiarity with evaluating and composing contracts and various legal papers.
  • Personal efficiency, time management skills, and the capability to function under stress.
  • Effective written and spoken communication (comprising excellent presentation abilities).
  • Skilled in utilizing technology and Microsoft Office applications.
  • Skills in analysis and problem-solving.
  • Outstanding personal and professional ethics and honesty.

Education

Further Education and Training Certificate (FETC): Business, Commerce, and Management Studies (Necessary)
