Home Office announces New Immigration Rules from 12 April 2023. This article briefly highlights the new UK immigration rule set to operate in April 2023.
Per UK immigration laws, those who have lived in the country continuously for ten years may apply for indefinite permission to remain. Right now, any form of permit to stay is considered to be a legal residency. This includes those in a temporary category and a long-term immigration route for settlement.
However, the temporary immigration category, including short-term student visas, visitor visas, and temporary admission granted until an application for humanitarian protection or asylum processing, may exclude from lawful residence from April 2023.
Don’t forget applications filed before 13 April 2023 will follow the current rules while applications submitted after 12 April will follow the new rules even if an applicant’s period of residence dates before 12 April 2023.
Interestingly, this change will specifically target people living in the UK for 10 years set to file for indefinite leave to remain.

The guideline does not specify that applicants should have lived in their current residence continuously for 10 years before filing their application. As a result, a child who spent 10 years living in the UK before going back to their country of origin qualifies to apply for an indefinite leave of absence to stay as an adult considering the amount of time they have already spent in the UK.
However, the duration of an applicant’s stay of 10 years which counts as a qualifying period, will change after April 2023. The new policy proves frustrating because of the anticipated prolonged time to decide on applications.
Additionally, the Home Office cannot comply with a specific timeframe. Fixing a reasonable timeframe to decide on an application becomes increasingly challenging.
Furthermore, it becomes more difficult to determine an acceptable timeline to follow the lengthier it takes to evaluate an application.
