Global Talent Stream Jobs: Issue Yourself a Job Offer in Canada Under the GTS

It is generally known that you can use LMIA exempt and even LMIA programmes to issue yourself or your client a job offer from a company in Canada. This can involve ICT, C10, C11, providing an LMIA through your own operational business, or even a Startup Visa employment offer for the work permit option.

But did you know that in some situations, you can make a job offer to yourself through the Global Talent Stream (GTS) for a highly specialised and unique position? Claim 200 points, a fast-track work permit to Canada, or both – all with a Startup business under this programme.

There are two streams within the Global Talent Stream.

  • Stream B applies when an operating business seeks to hire a highly trained foreign worker in a certain occupation.
  • Stream A is the GTS stream that is relevant to the topics discussed in this article.

Global Talent Stream A is not occupation-specific and requires a local referral partner. Each province and region has local referral partners who can approve and refer a local firm to Service Canada so that it can qualify for the GTS programme. These referral partners can include government organisations, non-profits, and so forth.

There are two processes to creating a job offer and getting approval for Stream A for a new startup in Canada:

  1. Establish the entity and pitch the referral partner (this is the most challenging step).
  2. Apply to Service Canada for final approval (this is much easier).

We will go over the steps and critical topics for both stages. If you or your client meet the basic eligibility requirements, you may be eligible for PR on arrival under this programme.

Why the Global Talent Stream Path?

It is critical to understand why someone would utilise this approach or programme rather than the standard LMIA or LMIA-exempt streams.

  • A corporation would use this instead of the Intra-corporation Transfer programme to establish an entity in Canada because the overseas entity or person would not have majority control over the Canadian entity or the equity relationship required for ICT eligibility.
  • You can apply for a C10 LMIA exempt self-employed or entrepreneur work visa instead of or in addition to the C10 programme. After one year in operation, you can apply under the Global Talent Stream with your T2s and proof of financials to earn your 200-point NOC position, even if you do not have the usual NOC 200 firm structure.
  • Rather than conducting an executive LMIA through the purchase of a business or startup, the Global Talent Stream enables you to receive the executive or high-level NOC code without requiring a large organisation or going through a lengthy LMIA process.
  • Under LMIA-exempt streams such as ICT, C10, C11, and even SUV work permits, you or your client cannot claim the 200 points as an executive unless you structure and run payroll for the company for at least 12 months. However, under the GTS-A stream, you can earn a highly skilled NOC post without first running payroll. This is a speedier option for eligible firms and entrepreneurs. Not everyone is eligible for this, but those who are can save a significant amount of time.

Important considerations for the Global Talent Stream: 

  • No business plan required. They will not read it.
  • The starting business must be innovative, either creating something new or providing a distinctive upgrade/expansion to an existing Canadian enterprise.
  • You must demonstrate that you are unable to find the specific talent/skills for which you are employing or making an offer of employment within Canada.
  • The company should offer job opportunities to Canadians.
  • In order to commit to Service Canada, the company should be provided with complementary labour market benefits, including a transition plan for skill transfer/training.

Company Eligibility: Global Talent Stream Canada

The startup should have fulfilled at least these milestones:

  1. Company Incorporation in Canada
  2. CRA business number.
  3. CRA payroll number
  4. Service Canada Job Bank Account.
  5. Canadian bank account funded with a minimum of $250,000.

How to Prepare the Partner Pitch for the Global Talent Stream Canada?

When you approach the referral partner, you must have this information ready. Sometimes you must create the summary, while other times you are merely asked to fill out an intake form. Having this material prepared will offer you the best chance of succeeding.

Include a referral submission with headers covering the following topics:

  • Background of the company.
  • Details about the predicted growth
  • Outline of Upscaling Plans
  • Describe the business’s innovation? This is quite crucial. It definitely needs to be original and unique—not already accessible in Canada.
  • Analysis of the impact inside Canada/region for this new firm (a small preview of the Labour Market Benefit Plan – (LMBP)
  • The position description for the job offer that is being issued.
  • An explanation of the need for the position
  • Describe the Temporary Foreign Worker (TFW)’s particular skill set and how they will fill this post.
  • Provide a CPA-signed document confirming the financial sustainability of the starting ventures.

What Is Next for Global Talent Stream Canada?

After the referral partner approves your startup, you will be referred to Service Canada, which can take 1–2 weeks.

At this point, you must complete their application forms. The approval is mostly focused on the Labour Market Benefit Plan (LMBP), which you will pitch for your own or your client’s firm. These usually include plans to hire Canadians, talent transfers, Canadian training, and additional rewards for Canadian worker development.

Service Canada can take up to two weeks to make a decision on your application, after which you can apply for the work visa of the person to whom you are extending the job offer. There is no employer compliance fee because Service Canada will provide an LMIA upon your approval. The NOC code can be used for highly skilled professions, including executive levels, and it can also result in 200 Express Entry points, allowing your client to acquire PR upon arrival if they match the qualifying criteria for the FSW Express Entry stream.
