Francophone Mobility Work Permit 2023: LMIA Exemption for TEER 4 & Workers | Canada Immigration

Except for primary agricultural occupations, Canadian employers will no longer need to conduct a Labor Market Impact Assessment before hiring French-speaking or bilingual workers outside of Quebec who fall under the National Occupational Classification’s categories 4 and 5. This exemption will last until June 15, 2023.

Validity Period

This experimental program is in effect for two years. If you meet the qualifications and are planning to live and work outside of Quebec, the francophone Mobility work permit makes it simpler for Canadian employers to hire you without conducting a labor market effect analysis.

Who can Apply?

Applying on or after June 15, 2023, you are required to

  • Satisfy the fundamental prerequisites for receiving a work permit
  • Next, reside and work outside of Quebec in one of the three territories or nine Canadian provinces.
  • Also, be able to demonstrate intermediate-level French speaking and listening skills.
  • Likewise, this would be comparable to a Canadian Language Competency Level 5 or higher (NCLC).
  • Additionally, possess an employment offer for a position that falls within any of the National Occupational Classification (NOC) system’s Training, Education, Experience, and Responsibilities categories, except for jobs in primary agriculture.

Your spouse, common-law partner, or dependant children are possibly allowed to apply for an open work permit if they want to work in Canada. While you work in Canada, your dependant children may also attend school or university.

Steps your Canadian Employer must take before you apply

Your employer must; before you apply for a work permit.

  • First, use LMIA exemption code C16 for Mobilite Francophone to submit an offer of employment to Immigration, Refugees, and Citizenship Canada (IRCC) using the employer portal.
  • Pay the $230 employer compliance charge next.
  • Give you a 7-digit offer of employment number as well, which is needed for your application.

How to Apply

1. Make sure you have everything you need first.

You will need a working credit or debit card in addition to a scanner or camera to produce electronic copies of your documents to apply online.

Create an online account or sign in next.

A user account is required to apply online. Your account can be used for:

Steps for launching your application

After logging in, take the following actions:

  • Visit the account welcome page’s “start your application” section, first.
  • Click “Apply to Come to Canada” a second time.
  • Scroll down to the “You do not have a personal reference code section” on the following page.
  • Then select “Visitor visa, study permit, or work permit”
  • Choose “work” on the following page.

2. The document checklist

Make sure you provide accurate answers to these questions if you are applying from outside of Canada.

Choose either temporarily: more than six months or temporarily less than six months based on the employment offer.

2. Your employer may have applied for an LMIA or provided you with an offer of employment number.

3. What kind of work authorization do you wish to request?

“A work permit with a Labor Market Impact Assessment exemption” is the option to select.

Applications Submitted after June 15, 2023

  • You must provide documentation demonstrating that you can speak and listen at a level of NCLC 5 or higher. Results from the Test de Connaissance du français (TCF) or the Speaking and Listening Test of Evaluation of French (TEF) may be included.
  • Moreover, a formal confirmation of a French program from a college or university
