To be eligible for open work permits, IRCC strives to process all spousal sponsorship applications in 12 months.

Family members may qualify for an open work permit if they have the same residential address as their sponsor in Canada and have a valid temporary resident status, maintain their status, or are eligible for and have applied to restore their status, according to IRCC.

Foreign National

The foreign national is a;

  • First and foremost, a principal applicant who has filed a permanent residence application under the spouse or common-law partner category. Or, a spouse, common-law partner, or conjugal partner under the family category approved for processing by IRCC.
  • Secondly, has submitted a work permit application with a maximum two-year permit period requested.
  • Third, the recipient of a sponsorship application made by their common-law partner (a Canadian citizen or permanent resident)
  • Fourth, at the time of application, shares the same Canadian residential address as their sponsor.
  • Also, possesses a valid temporary residence visa for Canada or is qualified for and has applied for status restoration.

On the other hand, foreign Nationals also is

  • A dependent child listed as an accompanying family member in the application for permanent residency comes first.
  • Secondly, has submitted a work permit application with a maximum two-year permit period asked.
  • Also, shares the same Canadian residence as the major applicant and their sponsor at the time the application was submitted.
  • Lastly, possesses a current temporary residence visa for Canada or is qualified for and has applied for status restoration.

Canada’s Ongoing Commitment to Family Reunification

Immigration Minister Sean Fraser announced the aforementioned action on May 26. Along with other policies to promote family reunification came the introduction of open work permits for Outland spousal sponsorship.

  • Faster processing times for spousal applications for temporary residence visas (TRV)
  • Additionally, new processing tools specifically designed for spousal TRV candidates
  • Lastly, open work permit renewals for those whose permits expire between August 1 and December 31, 2023
