Australia Immigration Tips | Requirements For The Subclass 494 Skilled Visa Application

The Skilled Employer Sponsored Regional (Provisional) (subclass 494) Visa allows regional firms to address labor shortages by sponsoring skilled workers in areas where sufficiently skilled local people are unavailable.

Individuals who are given a 494 visa can stay in Australia for up to five years as long as they keep their designated job in the designated regional area. After three years, they can apply for permanent residency. Dependent family members can be included, but they must live, work, or go to school in a certain place.

If a worker is given a 494 visa, they can stay in Australia for 5 years from the date of the visa’s issuance and travel to and from Australia as many times as they want during that time. The best part is that they can apply for permanent residence in Australia starting November 16, 2022.

Subclass 494 Visa Streams

The subclass 494 visa is divided into two categories:

  • The Employer-Sponsored Stream and
  • The Labour Agreement Stream

Required Documents

When applying for a subclass 494 visa, applicants must present the following documents:

  • Identification documents
  • If applicable, age exemption documentation
  • Qualifications and skills documentation
  • Documents in the English language
  • Medical records
  • Documents of character (Australian police certificate)
  • Partner documents (documents proving the identity and character of the partner, as well as a marriage certificate or proof of a de facto connection)
  • Identity and character documents are required for dependents under the age of 18.
  • Parental responsibility documentation demonstrating authorization for the kid (under the age of 18) to visit Australia
  • Identity and character documents are required for dependents over the age of 18.

When applying for a subclass 494 visa, applicants must meet particular conditions in addition to the requisite documentation.

Eligibility Requirements 

The Employer Sponsored Stream

For a period of five years, individuals who are in possession of this visa are restricted to living, working, and pursuing educational opportunities inside the regions that have been recognized by Australia. Except for the cities of Sydney, Melbourne, and Brisbane, the entirety of Australia is categorized as a regional area. A person who has a subclass 494 visa can apply for permanent residence if they are eligible to do so three years after the visa has been awarded.

Applicants must meet the following requirements to be eligible for the subclass 494 Employer Sponsored stream:

  • Unless an exemption exists, you must be under the age of 45.
  • Have applicable skills, qualifications, and job experience and be nominated by an approved sponsor
  • Have a good skill evaluation
  • Possess proficient English language skills
  • Comply with health requirements
  • Comply with the character requirements
  • Not having had a visa revoked or a previous application denied
  • You owe no money to the Australian government.
  • Sign the Australian Values Declaration.

The Labour Agreement Stream

People with skills who have been nominated by their companies and are covered by a labor agreement can go through this stream. Labor agreements are formal contracts between the Australian Government and businesses. They let foreign workers get a skilled visa that lets them work in Australia for a certain amount of time in a certain job.

If employers talk to the Australian Government, they might be able to get some “concessions” when it comes to application or visa conditions. Changes to the age, skills, credentials, work experience, level of English language ability, labor market testing, and wage requirements set out in migration law that are needed to be nominated for and receive a subclass 494 visa are called concessions.

People sponsored through the Labour Agreement stream can live, work, and go to school in the region of Australia they are given for five years. This is the same for people sponsored through the Employer Sponsored stream. If they are qualified, they can try to stay in the country permanently after three years.

Eligibility Requirements 

Applicants must meet the following requirements to apply for subclass 494 under the Labour Agreement stream:

  • Working under a collective bargaining agreement
  • Unless otherwise specified in the labor agreement, be under the age of 45.
  • Possess the necessary abilities, qualifications, and job experience.
  • Have a good skill evaluation
  • Meet the English language competency level required in the labor agreement.
  • Comply with health requirements
  • Comply with the character requirements
  • Not having had a visa revoked or a previous application denied
  • You owe no money to the Australian government.
  • Sign the Australian Values Declaration.

Subsequent Participant

The Subsequent Entrant visa is a subclass 494 visa that is intended for family members who wish to have the opportunity to join the initial subclass 494 visa holder in Australia at a later time. These family members must submit their application for their subclass 494 visa separately.

To apply for a subsequent entrant visa under subclass 494, candidates must:

  • Have a principal Skilled Employer Sponsored Regional (Provisional) (subclass 494) visa holder in your family.
  • Must be nominated by the primary subclass 494 visa holder’s employer.
  • Possess functional English. (If a functional English level cannot be demonstrated, an extra visa application fee is required.)
  • Comply with health requirements
  • Comply with the character requirements
  • Not having had a visa revoked or a previous application denied
  • You owe no money to the Australian government.
  • Sign the Australian Values Declaration.
