1. Obtain a Visitor Visa (TRV)

  • Extending your visitor visa will cost you $100 CAD per person.
  • To reclaim your tourist status, you must pay a visa fee of $200 CAD
  • Demonstrate that you intend to exit the country following your visit.
  • Demonstrate that you have enough money to support yourself and any accompanying family members while in Canada.
  • Be in good health and willing to undergo a medical exam if necessary.
  • You must not have a criminal past and be prepared to submit to a police background check.
  • Be prepared to present all supporting documentation upon the visa officer’s request.

Processing Times for Visitor Visas

A TRV application typically takes 16-20 days to process, but owing to application backlog, the most recent processing period is about 135 days. Even if it is more, make sure to give adequate paperwork to avoid any delays.

The Visitor Visa Application Process

Visitor Visa to Work Permit (No LMIA Required)

Only the following are eligible for an open work permit without LMIA:

  • You can apply for an open work permit as a temporary visitor if your spouse or common-law partner possesses a study permit and is studying in a DLI.
  • You can apply for a work permit as a tourist visa holder if your spouse / common-law partner possesses a work permit and is working in occupations included in NOC 0, A, and B.
  • You may apply for a work visa as a guest if your spouse or common-law partner is awaiting PR and has “approval in principal” status.
  • If you applied for PR through Spousal Sponsorship, you can apply for a work permit while you wait for a decision.

3. Changing a Visitor Visa into a Work Permit in Canada

You can apply for a work visa from within Canada after receiving a positive LMIA from a Canadian employer.

On February 28, 2023, IRCC stated that foreign people who are already in Canada on a visitor visa and have a legitimate employment offer will be allowed to apply for and acquire a work permit without leaving the country. The temporary public policy has been extended for an additional two years, until February 28, 2025.

Following that, you must go through a process known as Flagpoling. Visitors must exit Canada through the US border, apply for a work permit, and then re-enter Canada under this temporary arrangement.

4. Interim Work Authorization

We have already discussed the steps to follow in order to change a visitor visa in Canada into a work permit. Now that we have everything out of the way, let’s have a look at how the Interim Authorization operates.

After submitting your application for a work visa while in tourist status in Canada, you need to wait roughly 132 days. It indicates that you won’t be able to find gainful employment until they approve your work permit.

This matter was resolved when the IRCC published what it called an “Interim Authorization to Work.” You will be able to acquire this authorization to work much more quickly if you have it.
