New Zealand Tightens Regulations for Accredited Employers | New Zealand Rules 2024

A new regulation being implemented by the government of New Zealand requires authorized employers to have direct communication with Work and Income. With effect from October 7, this program aims to improve the labor market by giving local candidates precedence over migrant workers.

Stricter guidelines for approved companies have been implemented by the New Zealand government as part of an update of its immigration laws. To strengthen the integrity of the labor market and give priority to local workers, the new regulations require firms to communicate directly with Work and Income.

To enhance the Labor Market Test and advance equitable employment opportunities for New Zealanders, the government is working to streamline the recruiting process and guarantee that firms thoroughly evaluate domestic candidates before selecting overseas workers.

New Requirements for Employers

1. Accredited Employers’ New Direct Engagement

A direct line of communication between accredited companies and Work and Income regarding available positions will be mandatory as of October 7. The new order urges employers to be more hands-on in these encounters, whereas previously these conversations were handled by immigration professionals. Positions classified at ANZSCO Level 4 or 5 during the Job Check process are the main targets of this modification.

2. The Need to Advertise for Higher-Paying Positions

For job vacancies offering a wage of at least NZD 59.32 per hour—double the median wage from February 2023—or positions listed on the Green List, firms must either publicize the role or engage with Work and Income. This mandate makes sure that before companies try to hire migrant labor, they consider hiring New Zealanders for employment openings.

3. Enhancing the Integrity of the Labor Market

The administration thinks that taking immigration experts out of the picture will improve the integrity of the Labor Market Test. Employers will be incentivized to thoroughly evaluate the local labor market for suitable candidates before pursuing overseas talent if they enforce direct contact.

4. Better Interaction with Income and Work

In the past, Work and Income encountered difficulties when it was provided with the contact information of immigration experts exclusively. Employers must select a single contact person—such as a hiring manager, HR manager, or business owner—who is in charge of making employment choices under the new approach.

5. Using Recruitment Firms Is Permitted

Although companies are required to interact directly with Work and Income, they are free to work in conjunction with outside entities like employment agencies. Nevertheless, these organizations should not only offer immigration counsel during Job Check applications; they should also be active in the hiring process.

A Measure Towards a Sturdy Immigration Framework

This program is a component of the New Zealand government’s larger plan to change the laws about temporary work visas in response to concerns raised by several different sectors. The modifications aim to strengthen the integrity of the immigration system by making sure that companies take responsibility and actively consider New Zealanders for open positions.

The government of New Zealand is attempting to retain the nation’s attractiveness to skilled migrants while fostering a more equal labor market through these initiatives.
