Major Policy Update for U.S. Work Permit (EAD) Announced in April 2025

In April 2025, significant updates were announced regarding the Employment Authorization Document (EAD), commonly known as the U.S. work permit. This document is essential for many non-U.S. citizens residing in America.

Issued by U.S. Citizenship and Immigration Services (USCIS), the EAD permits eligible foreign nationals to work legally in the U.S. for a set period. This includes students, asylum seekers, and spouses of visa holders.

With the recent changes aimed at reducing delays and enhancing job flexibility, it is important to understand how the EAD operates, who qualifies, the types of jobs available, and the application process.

What’s New in 2025?

The 2025 updates introduce two significant changes to the U.S. EAD:

1. Automatic Extension of EAD Validity Increased to 540 Days

The Department of Homeland Security (DHS) has implemented a permanent rule that allows automatic extensions of certain EADs up to 540 days, an increase from the previous 180 days. This change protects immigrant workers from unnecessary employment gaps.

Who benefits from this new rule?

Applicants who:

  • Filed a timely renewal using Form I-765
  • Fall into specific immigration categories, including asylum seekers and TPS holders

2. New Edition of Form I-765 Now Required

Starting May 1, 2025, USCIS will accept only the new edition of Form I-765, dated 01/20/25. Applications submitted with older versions will be rejected. To ensure success, applicants must:

  • Download the latest form from the USCIS I-765 page
  • Complete all sections accurately
  • Include all supporting documents

Who Can Apply for a U.S. Work Permit (EAD)?

You may apply for an EAD if you fit into one of the following immigration categories and are currently in the U.S.:

  • C08: Asylum applicants with pending cases
  • A03: Refugees admitted to the U.S.
  • A05: Individuals granted asylum
  • C09: Applicants for Adjustment of Status (Green Card)
  • C33: DACA recipients
  • C26: H-4 visa holders (spouses of H-1B workers)
  • A17, A18: L-2 and E visa spouses
  • A12, C19: Temporary Protected Status (TPS) holders
  • C03: F-1 students (OPT/CPT authorization)
  • C05: J-2 visa holders (dependents of J-1)

What Kind of Jobs Can You Do With an EAD?

The EAD is not tied to a specific employer. You can work for any company in any field, whether full-time or part-time. Freelancing and starting your own business are also possible, unless restricted by your status. Here are examples of jobs you can pursue with an EAD:

  • Technology: Software Engineer, Data Analyst, UX Designer
  • Healthcare: Nurse, Medical Assistant, Lab Technician
  • Retail & Hospitality: Sales Associate, Chef, Hotel Manager
  • Education: Tutor, Research Assistant, Academic Admin
  • Logistics & Operations: Delivery Driver, Warehouse Worker
  • Freelance or Gig Work: Designer, Translator, Online Seller

Note: Some categories, like F-1 OPT, require jobs related to your field of study.

How to Apply for an EAD (Form I-765)?

  • Complete Form I-765 (01/20/25 edition).
  • Prepare Required Documents:
    • Copy of your passport ID page
    • Proof of current immigration status (I-94 or visa stamp)
    • Previous EAD (if applicable)
    • Two passport-sized photos
    • Filing fee (typically $520) or a fee waiver request
  • Mail the Application to the correct USCIS Lockbox address based on your eligibility category and state.
  • Receive Your EAD Card: Processing time ranges from 2 to 6 months. If eligible, you may qualify for a 540-day automatic extension while waiting.

Important Notes for Employers & Workers

Employers must verify your EAD using Form I-9. You cannot be denied employment solely based on an expired EAD if you are within the 540-day extension period. Remember, the EAD is not a visa, and not all visa holders qualify for it. Always check your category and legal status before applying.
