GREEN CARD UPDATE IN MAY 2023: GREEN CARD APPLICATION FEES INCREASING 53% FROM $535 TO $820

On March 13, 2023, the USCIS proposed fee increase came to an end. The agency had initially set a deadline of March 6th for public commentary and had received over 6,000 public comments. The proposed cost increases were met with criticism due to their potential impact on US businesses and families.

WHEN WILL THIS BE IMPLEMENTED

It’s currently unclear whether the agency will move forward with the fee increases proposed in January. The fee increases would apply to almost every category of immigrant to the United States, including employment-based visas like H1B.

For many marriage-based green card applications, the total fees would double from $1,760 to over $3,640. Additionally, fees for accompanying children will no longer be reduced, and their costs will minor adult applications. This means that for an immigrant family o four, the costs to bring a spouse and two (2) children to the United States could exceed $10,000 under this new fee proposal.

COMMENT FROM USCIS DIRECTOR

The USCIS Director, Ur Mendoza Jaddou, has stated that the new fee structure would allow the agency to improve customer service operations and manage the incoming workload. USCIS receives approximately 96% of its funding from filing fees and hasn’t introduced new fees since 2016. The proposed final rule published on January 4, 2023, led the agency to conduct a 60-day comment period before any modifications could take effect based on feedback.

After modifications occur, the final rule will be published, which can take place as quickly as 30 days after the end of the public comment period. The final published rule will state the date that the new rule will take effect, perhaps 30 days or more from the publication date.
If the final rule mirrors the recommended fee increases included in the proposal, these new fees could take effect as soon as May 2023.
