Good News! US Visa on Arrival, Green Card in 6 Months, No More Wait to Get Visa Interview Date

INTRO: USA VISA ON ARRIVAL

In the fiscal year 2023, a presidential advisory sub-commission on immigration and citizenship unanimously decided to expedite the visa application process and make arrangements to stamp many of those visas within the United States, rather than letting immigrants wait in the American consulate abroad.

According to the state department’s website, which currently lists the wait times for several countries. As an example, India currently requires 844 days to schedule a visa appointment, regardless of whether you receive a visa or not.

USA VISA ON ARRIVAL: PREVIOUS AND LATEST INTERVENTION

Previously voted to urge US President Joe Biden to process all green card applicants within 6 months.

USCIS’s new goals are aligned with the Green Card application within six months of the application being received by the agency. As a result, they anticipate that the community will soon hear some wonderful news: they can anticipate receiving their Green Card within 6 months of the date of application.

The latest suggestion is to handle visas for HI LI workers and the dependent families they support as well as for tourists and anybody else who might need a visa inside the US.

TYPES OF VISAS

HIB visa holders are given the chance to work in the United States, live there, and contribute to the expansion of our economy via innovation and economic development as part of their immigration process.

However, they encounter a problem because when H-1B visa holders must travel while their visa is valid for three years or six years, whichever period is longer, they must get a stamp placed on it for a specific amount of time.

Additionally, when they must travel outside the United States to their home country of India or any other country, they must also get a stamp to return to the United States.

FREQUENT DELAYS IN USA VISA APPOINTMENTS

Now, due to the frequent delays in visa appointments in the country’s home nations, they were unable to return home. For example, the current wait time for a visa appointment in India is 844 days, which is equivalent to more than two years in many other countries.

Bangladesh, among many others, and Pakistan are stranded since they can’t obtain an appointment or get their stamping done because China is currently much better.

The person might perhaps lose their employment. This suggestion simply advises USCIS to revise its policy to offer guidelines for allowing USCIS to extend and stamp visas in the United States, as it was done previously many years ago.

Instead, USCIS could think about giving these visa holders Advanced Travel Documents when they must leave the nation with expired visa stamping. So, they may enter the US without any problems or having to obtain new stamps in their home countries.

FAMILY-BASED BACKLOG REDUCTION

To lessen the backlog, we’re discussing enhancing the processing cycle times for family-based visas. Since the previous 30 years, there has been a steady increase in the Green Card backlog for family-based immigrants, making legal immigration and reunion challenging, if not impossible.

US citizens and holders of green cards who are seeking today to sponsor a family member overseas can prepare to wait decades. This will keep millions of families apart for decades.

Nearly 4 million people are presently waiting abroad in the family-based immigration backlog before they can reconnect with their families in the United States, and out of this final proportion, some of these belong to our community.

Since many family-based immigration avenues have been significantly backlogged for years, family reunification has been delayed and there are significant obstacles for people attempting to immigrate through authorized immigration venues. Hence, COVID-related shutdowns were minimal. Trump’s travel plans were impacted by the full or partial staffing of embassies and foreign advisers. All of these elements led to longer processing times, which made it harder to handle a large number of green cards.

BACKLOGS: USA VISA INTERVIEW

There were 4,21,358 pending interviews in April, down from 4,36,700 in March of this year, and just 65,452 family preference green cards were given in 2021 out of the 2,26,000 green cards available that year, keeping many more families apart.

It is advised that USCIS review its systems, processes, and policies and set new internal cycle time goals for streamlining processes, automating any manual approvers, improving internal dashboards and reporting systems, and enhancing policies to shorten the processing time for all forms and documents related to Green Card applications, DACA renewals, and all other applications.

Additionally, USCIS must respond to requests for travel papers, temporary status extensions, and work permits within three months.

2023, by creating 200-500 additional new offices, securing a budget, and implementing modified internal processing times by hiring more resources and officials as needed.

It is advised that USCIS divide the backlog for processing by skilled offices workers from other agencies and divide the backlog for processing by employees from other agencies by employing temps and contractors as Allowed by the law and boost the office’s Force by 200 to 250 to eliminate the backlog.

Additionally, it is advised that the National Visa Center, a facility of the State Department hire more officers to enhance their ability to process Green Card application interviews by 100 percent in three months starting in August 2022 and by increasing Green Card application visa interviews and education decisions by 150 percent from the present capacity of 32,439 in April 2022 by April 2023, eradicating the existing backlog by 2023.

NEW STEPS TO REDUCE THE BACKLOG IN IMMIGRATION

The second is new measures for reducing the current immigration backlog, which has increased from 5.7 million applications at the end of 2019 to approximately 9.5 million in February 2022.

The state department’s wait time for in-person counselor interviews or immigration visas peaked at 5,32,000 last July, and it now adds 60,900 numbers on average each
month.

We mean, the backlog can keep people in suspense for months or years, which has huge ramifications for families.

For example, someone applying for naturalization or driver’s license renewal may have their license revoked, or their lives may be negatively affected while they wait for EAD approval, which could result in them losing their jobs, the jobs of their families, or the jobs of their employers.

As a result, given the delays in the approval of work authorization documents that many immigrants currently residing in the United States face,

They advise USCIS to set new internal cycle time goals to be met by September 2023, some of which include getting some application forms and premium processing completed in two weeks and three months (1-765).

Accordingly, one of their recommendations was to automatically extend the EAD card, which USCIS implemented two weeks ago and will now do so automatically. Therefore, it’s a wonderful relief for the community, and we applaud USCIS for doing it as well as educating to obtain it.

Temporary employment programs, so it shouldn’t be an H2A Visa renewals extensions, within 2 months it’s advised to obtain work permits, travel papers, etc within 3 months, and then DACA renewals and green card requests for family members within 6 months.

Another issue is that many students and people who have been waiting with their parents for Green Card applications age out and fall out of status.

These people call themselves DACA, which isn’t a correct term, but we also want USCIS to treat them as special cases and find a way for them to pursue citizenship.
