About LMIA Farm Worker in Canada

Employment and Social Development Canada (ESDC) offers a document called a Labor Market Impact Assessment (LMIA) that assesses how hiring foreign workers will affect the labor market in Canada. If no Canadians or permanent residents are available to do the job, the LMIA procedure is utilized to establish whether international workers are needed to complete the task.

Most Canadian employers who want to engage a foreign worker must submit an LMIA. By allowing Canadian workers to apply ahead of time for job openings, the LMIA method helps to ensure that hiring foreign workers won’t have a detrimental effect on the labor market in Canada.

An application to ESDC with information regarding the employment offer, the foreign employee, and the company is part of the LMIA process. After that, ESDC will assess the application to see if an overseas worker is required to fill the role or if any qualified Canadians or permanent residents are available. If the LMIA is accepted, the foreign worker may subsequently apply for a work permit.

It is important to keep in mind that not every project in Canada needs an LMIA. The LMIA requirement does not apply to some works, such as those included in the International Movement Program (BRAT) or those designated as “LMIA-exempt.” Certain employment license exemptions under international trade agreements like NAFTA, those about intra-company transfers, and expert and social exchanges
