DHS Announces 89 Countries Eligible for H-2A and H-2B Visa – US Immigration

The H-2A and H-2B Visa programs’ qualifying nations are announced by DHS. Following consultation with the Department of State (DOS), the Department of Homeland Security (DHS) has released the list of nations whose citizens can take part in the H-2A and H-2B Visa programs in the upcoming year.

On November 9, 2023, a notice listing the qualified nations was published in the Federal Register. Include Bolivia on the list of nations that can take part in the H-2A and H-2B programs. The list of eligible countries can be found below. DHS retains the right to modify the lists of eligible countries at any time.

DHS and DOS assess that a country does not meet the standards for continuous designation by publishing a notice in the Federal Register. Fraud, abuse, non-immigrant visa overstay rates, and other instances of non-compliance with the terms and conditions of the H2 Visa programs by nationals of that country that are against US interest are examples of factors that could result in the exclusion of a country or its removal from the list.

H-2A and H-2B Visa Programs

Employers in the US can hire foreign nationals for temporary positions in agriculture and non-agricultural fields, respectively, through the H-2A and H-2B Visa programs. Only nationals of nations that the Secretary of Homeland Security has identified as eligible to participate in the programs may have their H-2A and H-2B petitions approved by USCIS.

On a case-by-case basis, USCIS may grant H-2A and H-2B petitions, including those that were pending as of the Federal Register notice publication date, for citizens of nations that are not on the lists, provided that doing so is deemed to be in the best interests of the United States.

Nationals of the following nations can apply for H-2A and H-2B visas as of November 9, 2023;

While they cannot engage in the H-2A program, the aforementioned countries are qualified to participate in the H-2B program. While Paraguay can take part in the H-2A program, it cannot take part in the H-2B program.

Further Details

It should be noted that the Taiwan Relations Act of 1979 and US statutes refer to or relate to foreign countries, nations, States, governments, or similar entities for all references to a country or countries in this article. These conditions will involve the application of such legislation to Taiwan.

Consequently, any references to a country or countries in the regulations controlling the eligibility of people of a country to participate in the H2 program. This is in line with the policy of the US, Taiwan, and China, which has allowed the US to have unofficial relations with Taiwan since 1979.

Major USCIS Update: New Filing Location for Form I-907 with I-140! (Effective Nov 13, 2023)

USCIS modifies the form I-140 filing location for form I-907. Commencing on November 13, 2023, US Citizenship and Immigration Services will be moving the filing location for Form I-907, Request for Premium Processing, when filed with Form I-140, Alien Worker Petition, from the service centers to the USCIS lockbox.

The USCIS lockbox will replace the USCIS service centers as the filing venue for newly submitted forms I-140 filed concurrently with form I-907 as of November 13, 2023. Therefore, as part of our initiatives to boost productivity through process digitization, cost reduction, and a smaller physical footprint at the service centers

If you are filing form I-907 for a form I-140 that is pending or if you are filing form I-140 along with an associated application (such as form I-765, form I-131, or form I-485), this change in filing location is not applicable. Form I-140 Immigrant Petition for Alien Worker should be submitted with the service senders mentioned on the direct filing addresses page; USCIS will shortly announce changes to the filing site for these applications.

Any form I-907 filed with a form I-140 that has an associated form (I-131, form I-485, or form I-765) will be rejected by the lockboxes. Form I-907 requests of this kind should still be submitted to the service centers indicated on the direct filing addresses for form I-140

Please utilize the following addresses starting on November 13, 2023, when mailing Form I-140 and Form I-907 to USCIS jointly. Any form I-907 filed with form I-140 obtained at the prior service center address will be rejected by USCIS as of December 13, 2023. Send your completed form to;
