Canada Work Permit 2024: New Caregiver Immigration Programs | IRCC

Caregivers have long been welcomed in Canada as a means of bolstering its economy and society. Canada constantly seeks to update its immigration laws and initiatives, which is one of the reasons it has a top immigration system.

In recent years, Canada has changed its caregiver pathways for long-term residents. For caregivers who want to move permanently, it runs two trial programs at the moment. While they wait to become permanent residents, applicants are also permitted to get temporary work licenses through the pilots: the Home Support Worker Program and the Home Child Care Provider Pilot.

A maximum of 2,750 principal applicants may be accepted into each program, for a total of 5,500 principal applicants annually. Please take note that as of April 30, 2023, caregivers can now obtain permanent residency in Canada with only 12 months of work experience instead of the previous 24 months. Caregivers who have previously applied will continue to get the retroactive work experience change.

Home Child Care Provider Pilot and Home Support Worker Pilot

Caregivers who fulfill the following requirements can apply for permanent residency through the Home Support Worker Pilot and the Home Child Care Provider Pilot;

  • Possess a minimum of 12 months’ worth of full-time, qualifying job experience in the 36 months before applying.
  • Results of the language test: displaying a language from Canada Five-point benchmark
  • A year of postsecondary education in Canada, or its equivalent elsewhere
  • Obtain a clean record in terms of health, criminal history, and security.

Qualifying Work Experience

The following details are provided by Immigration, Refugees and Citizenship Canada (IRCC) regarding their requirements for work experience for pilots.

Within 36 months of seeking a pilot program, you must have at least 12 months of full-time employment experience. The work experience needs to correspond with any of the 4411 or 4412 National Occupational Classification (NOC) codes. One of these jobs has to be the experience you have had. Combining the two jobs is not possible. You must prove that you fulfilled the majority of the primary responsibilities and that your work matched the NOC job description.

It’s sufficient to have 12 months of job experience overall; it’s not necessary to have 12 months straight. Working for pay for at least thirty hours a week is considered a full-time job.

Through the Home Child Care Provider Pilot, caregivers who have work experience in NOC 4411—apart from foster parents—may be eligible for permanent residency. You are required to look after minors in your house or at the home of your employer. To be qualified, you are not required to reside in your employer’s house. Foster parent work experience is not accepted.

Through the Home Support Worker Pilot, caregivers who have job experience in NOC 4412—housekeepers excluded—may be eligible for permanent residency. You have to have looked after someone who needs home support worker assistance. This may have happened in your house or the house of your employer. To be qualified, you are not required to reside in your employer’s house.

Experience as a housekeeper does not qualify one for NOC 4412; only home support workers are eligible.

Language Levels

You must pass an English or French language exam designated by the IRCC and receive a CLB or NCLC 5 in each of the four language proficiency domains: writing, reading, speaking, and listening.

Education

You have to have finished a minimum of one year of higher study. This can include education from abroad or in Canada. You need to get an evaluation of your educational credentials if it’s foreign schooling.

Admissibility

To make sure that new immigrants do not endanger Canadians’ health and safety, the Immigration and Refugee Committee (IRCC) investigates applications for permanent residency. Various documents are required for each applicant based on their background. IRCC outlines its guidelines for applications and requirements based on your history.

You might be required to provide a police clearance certificate, a medical test, and biometrics. It is crucial that you thoroughly read the IRCC’s application requirements to determine which papers you must provide.

Work Permit Pathways for Caregivers

If you are presently resident in Canada or are applying to one of the pilots, you might be qualified to receive a work permit. These are the guidelines for work permits:

Under these Pilots, IRCC divides applicants into two groups. Whether an applicant has 12 months of eligible Canadian work experience under NOC 4411 or NOC 4412 determines which category they fall into.

Category A

if you have worked in Canada for 0–23 months and are eligible. You must apply for an occupation-restricted open work permit if you do not currently have 12 months of NOC 4411 or NOC 4412 work experience in Canada.

If you meet all requirements for permanent residence eligibility and submit your application under either pilot, you will be granted a work permit restricted to NOC 4411 or NOC 4412, which will allow you to enter Canada temporarily and obtain 12 months of work experience within three years. Beginning on the day the work permit is granted, the three-year term

Category B

When filing your application for permanent residence under either pilot, you do not need to apply for an occupation-restricted open work permit if you have already completed 12 months of qualified Canadian work experience under either NOC 4411 or NOC 4412. Applying for a Bridging Open Work Permit is something you can do.

Your immigration application won’t be handled once it’s been submitted until the IRCC determines if you qualify for permanent residency. Your dependents and spouses may travel to Canada with you and apply for their open work visas.

In-home Caregivers Temporary Foreign Worker Program Stream

When there are no Canadians or permanent residents available to assist with the task, families can engage foreign caregivers to help youngsters, the elderly, or those with documented medical needs. The caregiver must work in the private home where the care is being delivered and provide care full-time, for at least 30 hours a week.

In positions like NOC 4411, the caregiver can help with children under the age of eighteen. They can also help those with impairments or significant illnesses, as well as elders 65 years of age and older. They can work in positions like NOC 4412, NOC 3200, and NOC 3233. Families apply for and are granted approval for a Labor Market Impact Assessment (LMIA) from the Canadian government.

After that, the foreign caregiver can apply to Immigration, Refugees, and Citizenship Canada (IRCC) for a work permit. But it’s crucial to remember that caregivers covered under NOC 4411 and 4412 can only get work permits if certain requirements are met.

Caregivers who will work outside of Quebec in any province or area
For IRCC to process their work permit, they must be residents of Canada. If you live abroad, IRCC will not process your work permit.
The caregivers who will work in Quebec may live there or elsewhere. As long as the requirements are satisfied, IRCC will proceed with processing the work permit.
