CAN INTERNATIONAL STUDENTS TRAVEL TO UNITED KINGDOM WITH THEIR MARRIAGE PARTNERS
The answer to this question is a yes. Some students are eligible to bring their partner and children to the UK on a dependent visa. Immediate family dependents of Tier 4 (General) student visas are granted limited settlement rights. That is the right to live and work in the UK, while their partner studies full time. This creates an exciting opportunity for couples. The following provides guidance on which students are eligible to bring dependants.
OPPORTUNITY FOR COUPLES
When it comes to couples, one partner can apply as the main applicant for the Tier 4 (General) student visa. The main applicant is committed to full-time studies in the UK. There is a provision for the main applicant to work a maximum of 20 hours per week (part-time work) as long as it is incidental to their studies.
The married partner is known as “family dependent” will be granted permission to be in the UK with their partner. That permission to join their partner permits and give working rights. This means that the partner can study full time while the other partner works to cover living expenses.
COMPLICATIONS
- The couple needs to be able to provide evidence of a legally recognized relationship equivalent to marriage.
- The main applicant will be paying international student fees. That means they are going to require a minimum of R300k to gain entry for their first year of studies. Except for Scholarships, fellowships, or grants.
- At the end of their visa, there is no easy way to stay in the UK. This means that extending their stay carries a high risk of not being granted.
- There is some provision for these cases but it is easy.
SPOUSE VISA REQUIREMENTS
- To qualify for a UK spouse/marriage visa you must satisfy these requirements:
- You and your spouse must be 18 years and above
- You must be legally married; this is to prevent arranged marriages.
- You must intend to live together permanently.
- You must have enough money to support yourselves ( any dependents) without claiming public funds.
- Your sponsoring partner must earn more or have enough savings to be able to sponsor you. The minimum financial requirement is higher if they are also sponsoring dependent children.
- You must have suitable accommodation for yourself, your spouse and any dependants.
- You must satisfy the English language requirements.
HOW TO APPLY FOR A SPOUSE VISA
- You can apply for a spouse visa from overseas or from within the United Kingdom.
- If you are already in the UK on a fiance visa, work visa, and student visa valid for more than six months, you may be able to switch to a spouse visa.
