Australia Targets Student Visa Holders for Work Violations

Australian authorities have stepped up their surveillance of international students surpassing allowed work hours, resulting in visa cancellations and increased worries among the student population.

Reports suggest that international students exceeding the 48-hour biweekly limit have drawn official attention, with some at risk of deportation.

Crackdown on Extra Work Hours

Student organizations in Australia have noted a considerable rise in scrutiny of businesses hiring international students. Recent inspections focused on around 40 establishments in Melbourne and its nearby regions. This enforcement has placed students putting in extra hours on high alert.

Visa Cancellations Raise Concerns

A letter regarding visa cancellation that is spreading on social media has heightened worries among Indian students. The letter allegedly outlines the expulsion of a student working 50-60 hours each week while participating in a graduate diploma course. This event has sparked extensive dialogue and concern among the community.

Uncertainty About Job Categories

Students continue to experience uncertainty about how different job roles are classified. Numerous students, especially those employed as taxi drivers or delivery workers, feel that these “self-employed” roles under an Australian Business Number (ABN) are not subject to the 48-hour work restriction.

This confusion has caused a number of individuals to inadvertently violate visa rules. Students employed at grocery stores, gas stations, and comparable venues using a Tax File Number (TFN) are more mindful of the limitations.

Student Associations Issue Warnings

Student organizations are proactively guiding students to comply with visa rules. They highlight the significance of focusing on studies and restricting work hours to the designated 48 hours every two weeks during the academic term.

Students are allowed to work unlimited hours during vacation times. The organizations also emphasize the lasting advantages of finishing their education, including the opportunity for temporary residency visas, which provide higher earning potential.

Counselling Efforts Underway

Community leaders and organizations are offering counseling services to students, encouraging them to handle their finances wisely and protect their visa status. They emphasize that putting in too many hours for quick financial rewards can lead to serious repercussions, such as visa revocation and removal from the country.

Employment Regulations for Students in Australia

International students in Australia are required to adhere to strict work rules to keep their visa status intact.

  • Work Hours: A maximum of 48 hours every two weeks during academic terms; no limit on hours during course breaks.
  • Visa Requirement: Must possess a subclass 500 Student Visa that includes work rights.
  • Job Categories: Positions with TFN (retail, corporate) are controlled, whereas ABN (freelance) might still be overseen.
  • Dependents: Spouses of master’s/PhD students are permitted to work full-time, while others can only work up to 48 hours every two weeks.
  • Violations: Exceeding work restrictions may result in visa revocations and removal from the country.

Anticipating the Future

The more rigorous monitoring of work hours underscores the importance of Indian students in Australia adhering to visa regulations. Effective communication between student organizations and authorities is crucial to defining job classifications and guaranteeing equitable handling in managing intricate visa policies.
