With these amended rules, immigration officials can cancel temporary resident documents under specific conditions. For instance, if an individual’s status changes, they may become ineligible. This could occur if they provide false information or have a criminal record. Additionally, if an officer suspects that the individual will not leave Canada upon the expiration of their stay, they can take action.

Other reasons for cancellation include loss or theft of documents or issuance errors. Furthermore, when a temporary resident transitions to permanent residency, their previous documents become void.

These alterations are likely to affect thousands of foreign nationals, especially a considerable number of Indian students and workers. The Immigration, Refugees, and Citizenship Canada (IRCC) emphasized that these changes aim to enhance the integrity of Canada’s temporary residence programs. They believe that the new regulations will improve border security and protect Canada’s immigration system.

Implications for Indian Students and Visitors

Canada remains a highly sought-after destination for Indian students, with approximately 427,000 currently enrolled in various institutions. However, the new policy raises concerns about the potential revocation of study permits. Such cancellations could disrupt not only students’ education but also their future career plans.

Between January and July 2024, Canada issued 365,750 visitor visas to Indian nationals, marking an increase from 345,631 during the same timeframe in 2023. Although students can still apply through the Regular Study Permit process, the removal of SDS has raised concerns. Many fear that the combination of this suspension and the new cancellation rules will result in increased delays and uncertainty.
